  • No Warranties on Data: We make no claims regarding the accuracy, reliability, or completeness of the data. Tickers, prices, and calculated ratios may contain errors, omissions, or technical glitches.
  • Corporate Actions & Revisions: Financial data is inherently subject to adjustments. We and our data providers are not responsible for missing or inaccurate data regarding corporate actions (such as dividends, stock splits, or mergers) or historical revisions to macroeconomic data.

4. Disclaimer of Warranties ("As-Is")

5. Limitation of Liability

To the fullest extent permitted by law, Plotting Tools, as well as its third-party data providers (including but not limited to Tiingo), shall not be liable for any damages, losses, or expenses (including direct, indirect, incidental, punitive, or consequential losses) arising from:

  • Your use of the websites or inability to use the website.
  • Any financial losses, trading losses, or lost profits incurred as a result of relying on information found on this site.
  • Errors, mistakes, latency, or inaccuracies of content/data, including any missing dividend data or improperly adjusted historical prices.
  • Any claims brought against you by third parties relying on charts or statistics generated by our platform.

Limited Liability Cap: Notwithstanding the foregoing, the total aggregate liability of Plotting Tools to you for any direct financial damages proven to result directly from a defect in our tools or services shall not exceed the total amount paid by you to us for the Services (including any donations or subscription fees). You expressly agree that this is a reasonable and material term of these Terms, and you waive any right to seek recovery beyond this amount.

6. Subscriptions and Payments

We use third-party platforms, such as Buy Me a Coffee and Creem.io, to process voluntary donations and subscription fees for our services.

  • Third-Party Terms: When you make a transaction, your payment is processed securely by these providers, and you are also subject to their respective terms of service and privacy policy.
  • Access License: Payment for a subscription grants you a non-exclusive, non-transferable license to access premium plotting tools and data visualizations. It does not grant ownership of the underlying data or the statistics generated by the system.
  • Refund Policy: Donations are voluntary and non-refundable. Subscriptions may be cancelled at any time, but (partial) refunds for the remaining subscription period are not provided unless mandated by Dutch consumer law.
  • Checkout Communications: By initiating a checkout process via our Merchant of Record, Creem.io, you acknowledge that they may send you transactional emails, including reminders for incomplete purchases (abandoned carts), in accordance with their own privacy policy and our Privacy Policy.

7. Proprietary Information and Data Ownership

Plotting Tools retains all intellectual property rights to the Website, its proprietary algorithms, and the results of computations performed using our integrated data feeds (e.g., statistics, correlations, and $R^2$ values).

  • Warehousing Rights: We reserve the right to warehouse, aggregate, and commercialize all statistical outputs generated through the use of public or paid ticker data available on the platform.
  • No Exclusivity: Users do not have exclusive rights to the statistics generated during their sessions. We may share, sell, or redistribute these calculated metrics to other users or third parties.

8. User-Uploaded Data and "Mixed" Computations

For users who upload their own data sets for custom analysis, the following protections apply:

  • Ownership of Uploaded Data: You retain full ownership of any data you upload to your private storage folder. Plotting Tools does not use, share, or claim ownership of your uploaded data.
  • Encrypted Storage: Your data is stored in an access-controlled encrypted cloud storage environment (Amazon S3) to ensure its privacy and security.
  • Mixed Computation Privacy: If a plot or calculation involves only user-uploaded data, or a mix of user-uploaded data and Websites-provided data, the results (including derived statistics) are temporarily cached only for your convenience and are not shared with other users in the platform, unless you explicitly provide a command to share them with your own defined list of users or user groups. Your uploaded data and its derivative plots and statistics remain private to you and to those users with whom you shared them.

9. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the websites signifies your acceptance of the updated terms.

10. Governing Law and Jurisdiction

1. These Terms of Service, and any non-contractual obligations arising out of or in connection with them, shall be governed by and construed exclusively in accordance with the laws of the Netherlands.

2. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

3. Any dispute, controversy, or claim arising out of or relating to these Terms of Service, or the breach, termination, or invalidity thereof, shall be submitted to the exclusive jurisdiction of the competent court in Maastricht, the Netherlands.

12. Third-Party Data Restrictions (Tiingo)

If a plot, chart, or calculated statistic incorporates data sourced from Tiingo (identifiable by tickers prefixed with T- or otherwise explicitly attributed to Tiingo), the following additional terms apply. In the event of a conflict between this section and any other provision in these Terms of Service, this section shall strictly govern with respect to Tiingo-derived content.

  • Permitted Use: Access to plots and statistics generated using Tiingo data is provided solely for your personal use or internal business purposes.
  • Prohibition on Redistribution: You may not resell, distribute, sublicense, or commercially publish (including, but not limited to, paid articles, external reports, or syndicated media) the derivative plots or the underlying data.
  • No Reverse Engineering: You are strictly prohibited from attempting to reverse-engineer, extract, decompile, or otherwise discern the underlying raw market data from the visualizations, statistics, or ratios provided by the Websites.
  • Data Ownership: You acknowledge that Tiingo retains all title, ownership, and intellectual property rights to the underlying raw market data used to generate these specific plots.
